Policies

The following procedures are designed to verify the details and costs of an Internet order and to prevent credit card fraud.

Payment

All Internet orders must be paid by credit card, or COD (by certified check). We accept Visa, MasterCard, American Express and Discover credit cards.

To pay by credit card, please print the Credit Card Authorization form, complete it and fax it to us for verification. Please note that if the "ship to" address is different from the your billing address, this alternate address needs to be registered with your credit card company by calling the 800 number on the back of your card. We will send you a credit card receipt, and an invoice, with your shipment.

Prices

Action Communications Inc. strives to ensure that all prices shown in our on-line catalogue are accurate and up to date. However, prices are subject to change without notice.

Authorizing Orders

We will confirm all orders by faxing you a completed invoice showing all charges and shipping details. Please confirm these details and authorize the order by signing the invoice and faxing it back to us.

If you are issuing a purchase order, please fax us a copy as well.

Satisfaction Guaranteed

If you are not satisfied with the equipment purchased, you may return the product to us within 10 days of the invoice date and we'll refund the full price, including tax, less freight and restocking charges. Please call for a return authorization.

Returned equipment must be in "like new" condition. Ship the equipment to us with a copy of your invoice in the original packaging. Local dealers cannot accept returns of merchandise purchased from us.

The Customer agrees to pay a restocking fee equal to 20 percent of the equipment's invoice value plus all return shipping charges. Proof of purchase is required for all returned merchandise.

Special orders cannot be canceled or refunded.

Delivery Options

All items are shipped by UPS Ground unless otherwise specified by the customer.

Odd shapes and orders weighing more than 150 pounds cannot be sent UPS. Delivery charges and delivery time vary by item and destination.

Radio Channel Programming

Programming is included in our price. You can obtain frequencies from your local repeater service provider. On-site frequencies are provided by us and will work anywhere. Programming changes can be made at any local dealer authorized by the manufacturer.

Leasing

You may establish your own leasing arrangements or use our leasing company. If you want to use our company, we will send you their credit application. Please complete it and return it to them for approval. Once approved, the leasing company will place an order with us and we will ship you the equipment.

Protection of Information

We constantly strive to protect all information exchanged in the bidding and ordering process. Our confidentiality procedures ensure that:

All information about your organization and order is closely held exclusively by us.

We limit access to confidential information to only those Action Communications employees who are directly involved in servicing your account.

We may occasionally use your customer information to make exclusive offers, or provide you with advanced notice of sales or special benefits that may be of interest to you.

New Product Warranties

It is understood and agreed by the Customer that the new product warranties offered through Action Communications Inc. are only those offered by the manufacturer unless otherwise noted on the invoice.

New batteries and accessories are warranted for 1 year. Both the manufacturer's warranties and Action's limited warranties cover all defects in material and workmanship for the period stated. Warranties will not cover equipment to which repairs are attempted by the Customer, or anyone else, other than Action Communications Inc., or a dealer authorized by the manufacturer of the equipment.

Installation of parts or accessories, product modification or failure to follow instructions contained in the operator's manual is also not covered. Damage due to removal of equipment from vehicles is not covered. Any unit which has the serial number defaced, modified or removed shall be considered abused and will not be repaired.

Action Communications Inc. and the manufacturer will not be responsible for ancillary equipment furnished by the Customer which is attached to or used in connection with the equipment. We disclaim any liability for range and coverage.

Warranty Repairs

All new radio equipment or accessories we sell carries a manufacturer's warranty. Warranty repairs or replacement can be handled by returning the equipment to us, or going to a local dealer authorized to provide repairs for the manufacturer.

Equipment presented for warranty repair requires proof of purchase showing complete purchase information prior to repair. Please safeguard your proof of purchase so we, or any other authorized dealers, can verify purchase date, warranty period, etc.

Action Communications Inc. and/or the manufacturer are not responsible under warranty terms for incorrect installation, abuse or misuse of equipment including damage by fire or water; breakage of antenna, microphone, battery or transceiver.

Liability Restrictions

Action Communications Inc. (ACI) provides links to other sites that are not maintained by us. We do not endorse those sites and are not responsible for the content of such other sites.

ACI is not responsible for any technical, hardware or software failures including network connections; incomplete or delayed computer transmissions; or for scrambled or incomplete information sent or received.

The Customer agrees that ACI shall not be liable for, and shall be held harmless, and shall be indemnified by Customer, for any and all claims and damages of every kind, including personal injury, special or consequential damages, arising out of the use of any service or equipment provided by ACI.

Governing Law

All terms and conditions shall be governed and interpreted only by the laws of the State of Arizona, United States of America.

Usage restrictions

The entire contents of this Web site are copyrighted and protected worldwide by treaties with the United States of America. Any information provided to Action Communications Inc. (ACI) through this site is the exclusive property of ACI. ACI is entitled to use any information for any purpose without restriction or compensation to the originator.
